COURT CASE OF OFFICERS (2011) IN ANDHRA PRADESH DIVISIONAL BENCH

Dear All,

We  are pleased to inform you that the above case was listed on 15.07.2013 in the Divisional Bench of High Court of Andhra Pradesh, Hyderabad. The Companys advocate has been asked for an adjournment and under the pretext that he was not prepared for arguments, as per the information received by us.
However, the Hon'ble Judge has informed to our legal councel that final hearing of the case will be positively on 22nd July,2013(Monday).  Understand that "No further adjournments will be allowed" in the case,  as informed by Mr. K.S. N. Murthy, who filed the above case is continuously monitoring/following it up with his advocate and communicating to us for publishing the information. 

Expecting a positive result / out come on 22nd July, 2013.

We wish to invite your urgent attention to the above and submit the following for your necessary action.. The promotional exercise from Assistant to SR. Assistant and Sr. Assistant to A.O is on anvil. Company has already published examination result of Para 13.2 and Rank list being published. We observe from the list that some names are appearing in both the list (Assistant to SR Assistant & in Para 13.2) . It is being apprehended by rank & file that if both the exercises go simultaneously, it may induce adverse impact on the exercise in the case of  Assistant to SR Assistant. Since there is no contingency list ever after the introduction of above said promotion policy(2008) in all the cadre, it so happened the vacancy lapses due to Employee opting higher cadre.

We had on earlier occasions taken up the matter with CORP.HRM, Mumbai and expressed our apprehention on the above matter. We therefore request your good selves to issue necessary instructions to carry out the promotion exercise only after publishing the Rank list of eligible candidates from Class-III to I otherwise employees qualifying for 13.2 will desert the post on selection as AO.

Sir, this may help a lot to Class III all over India and vacancy will be fulfilled as per the declaration in Sr.Asst cadre.

Uttarakhand flood claims to impact general insurers’ profit this fiscal

The recent Uttarakhand flash floods are likely to dent the profitability of general insurance companies in FY2014 as big ticket claims are expected from as many as 245 hydroelectric power stations, according to a senior industry official.
A large number of hydroelectric power stations have been damaged in the Uttarakhand belt. About 245 projects overall have been damaged in that area. Many of the projects are very small,” said A.K. Roy, Chairman and Managing Director of the country’s sole reinsurance company, General Insurance Corporation.

New India Assurance, the country’s largest general insurance company, received six claims so far from hydel power stations such as state-owned National Hydroelectric Power Corporation and about Rs 10 crore worth of individual claims, said a senior company official. During the Mumbai floods, the general insurance industry is estimated to have paid out claims of over Rs 4, 000 crore.
According to industry experts, the losses from Uttarakhand, which are still being ascertained, may be in a similar range. The biggest losses for general insurers are expected to come from hydroelectric power projects and the motor insurance segment as many vehicles may have been washed away.
Under current regulations, the domestic general insurers — both public and private sector — mandatorily pass on at least 5 per cent of their premiums they collect to GIC Re for reinsuring their risks. “We have already asked for information on the exposure of the general insurance companies in Uttarakhand. For larger claims, general insurers will have reinsurance. As a reinsurer, we are in a position to pay. But it will impact their results for the current year,” said Roy.
Catastrophe pool
The general insurance industry is also currently discussing the possibility of a natural catastrophe pool as a buffer against such natural calamities.
This pool will have a structured compensation for people and for the property which is not insured.

You are aware that we objected to some clauses of the Group Mediclaim Policy and we are in movement in a Joint Platform to stall the same till we come to consensus.This is to inform you that just now Mr. M. Parshad, CEO, GIPSA  has informed us that the GIPSA has taken a decision to defer the implementation of the Group Mediclaim Policy for 3 (three) months. Therefore,submission of Enrolment  Form is not required at present.

As you are all aware that , I had been advised rest and medicines for my heart ailments which was recently diagnosed and subsequent to the above I had requested Management to give a transfer at Ernakulam Regional Office for better conveyance and medical attention.
Unfortunately management took the request in other sense and thought that my presence will be again a threat for them and my colleagues were not able to convince them properly. Finally my request for this Office- adjacent to Regional Office ( in city)were made effective and reported here in this Office today.

RE: STAFF GROUP MEDICLAIM POLICY (FLOATER)
We are in constant touch with GIPSA authority about improvement of the above policy mainly for the following :

A. NO TPA ----- In house claim settlement as per existing system.
B.  Enhancement of Eligibility limit to reduce individual premium burden.
C. One time Option be relaxed and be given in every renewal.
D. Interim Sum Insured for option be given i.e., 5 Lac, 6 Lac, 7 Lac etc

Eight Checked Off Unions along with 2 Pensioners’ Association are jointly engaged in convincing the GIPSA Authority about the pros and cons of the new GMC Policy and awaiting favourable decision from the GIPSA. In the meanwhile it has been decided that all members are to obtain the enrolment form from the department concern and wait for our final instruction for depositing the same till 14th June,2013 since we are expecting some outcome by the time. For information please note that last date for submission of the Form for existing employees and retired employees are 18th June and 28 June, 2013, respectively as per H.O. guideline.

It has come to our knowledge that National Insurance Co. Ltd. and Oriental Insurance Co. Ltd. have started distributing enrollment forms for new Group Mediclaim Policy to the employees and retired employees ignoring the opposition of National Federation and other checked-off unions. You must be aware that we have formed a Joint Platform of checked-off unions for this issue and we have sought for your appointment in the next week for the purpose of submitting our Memorandum on this issue.

We demand postponement of launching of New Group Mediclaim Policy for employees and retired employees subject to our discussion with all the Checked-off unions with you and request you to instruct the companies not to issue such Enrolment Forms.

POSTPONEMENT OF ALL INDIA WORKING COMMITTEE MEETING OF "NFGIE"

In view of the  re-scheduling of date of pre-promotional examination on  8th and 9th. June 2013 instead of 2nd June,2013 by GIPSA  and many W.C. members  being candidates for the said  examination for Promotional Exercise 2013, the ALL INDIA WORKING COMMITTEE MEETING  of NFGIE scheduled to be held on 9th.June 2013 at Mumbai has been postponed.  The revised date for meeting will be communicated shortly. In all probability, to felicitate  railway ticket booking, it will  be better to hold the meeting in the later part of August 2013.Final date will be communicated to all by early next week. 

All are requested to cancel their railway/air tickets and arrange for fresh tickets booking on receipts of information of fresh date of  W.C Meeting.. Meanwhile all are requested to maximize efforts for souvenir collection to utilise this extenteded time. Also inform all well-wishers who have already booked space in the SOUVENIR  about the revised schedule.

 Expect you all have gone through NFGIE' observations and suggestions on proposed Staff Group Mediclaim 
( Floater) changes  which was sent to you in last week through e-mail .All Regional Secretaries are requested to send protest letters to PSU insurance companies as well as GIPSA management against unilateral and arbitrary changes in Staff Group Mediclaim Policy immediately.

LETTER TO GIPSA ON Revised terms of Group Mediclaim Policy (floater) covering employees/retired employees.

Sub: Revised terms of Group Mediclaim Policy (floater) covering employees/retired employees.

We have had the opportunity to go through the Revised Terms of GMC Policy covering employees/retired employees as contained in the Annexure - ‘A’, ‘B’ and ‘C’.  Our first hand observation on the subject are as below:

At the outset we record our strong dissensions and resentment at the high-handed, arbitrary and unilateral act and/or modus perpetrated by the framer of the said Revised terms of Group Mediclaim Policy, which it appears has been devised keeping an eye on Floater principle.  Whereas the GMC Policy concerns the interest of employees of GIPSA Companies, it is quite unbecoming that the authority did not have the courtesy to discuss the matter before hand with the representative bodies, not even the checked-off unions of respective classes of employees.  This amply demonstrates total biasness and prejudicial attitude of the GIPSA especially in dealing with employee matters as also maintaining cordial and harmonious relationship.

It goes without saying, the spirit and concept of the Mediclaim Policy was mainly intended to offer benefit to the insuring public and in the case of employees it was treated as a welfare measure.  But, strangely the number of conditions set out in the respective Annexure are totally to the contrary.  Stringent/derogatory and obnoxious conditions put forth to defeat the welfare aspect as a whole. 

In this background we urge that due steps m are initiated for modification of the conditions before giving effect to the revised terms of GMC Policy in consultation with the respective checked-off unions urgently. Pending such bipartite discussion vis-à-vis modification thereto implementation of the Revised GMC Policy be kept in abeyance.
For your due consideration we summarize hereunder our clause wise observation on the Revised terms of GMC Policy designed by GIPSA.

02.1.1       For employees Basic Pay

02.1.2.2     For employees Basic Pay between Rs.22731 & Rs.29000 –
                  Eligible Sum Insured be  Rs. 7,00,000/-                                                                          

02.1.2.3      For employees Basic Pay > Rs.29000>      
                   Eligible Sum Insured be Rs.10,00,000/-
                       
02.1.3         Eligible Sum Insured for retired employees shall be determined
                   based on the Basic Pay Last drawn on the date of exit from services
                   which should be notionally updated  keeping in mind past wage
                   revision(s).

02.2.6        Choice of available optional Sum Insured be Rs.7,00,000,
                  Rs.10,00,000, Rs.12,00,000, Rs.15,00,000, Rs.18,00,000
                 & Rs.20,00,000.       

02.2.0       In every renewal option for increase/decrease of Sum Insured be
                 given to  all serving and retired employees.

03.1.1      NO CAP on Room and ICCU/CCU rent charges and no other sub-limit
                for any other expenses .

03.2.1      For Free Medical Check up separate account be maintained for each
                members of the  Family e.g, every members of the family should be
                given free medical check up facility once in 2 Claim free years of policy
                in respect of particular member.
                       
04.1.2      GMC policy for independent family members of serving & retired
                employees be Continued and not to be discontinued on or after 1.4.2013

04.5.1      Retired employees who are not covered under the expiring GMC Policy
                be allowed to opt for coverage under the GMC Policy as per revised terms.

09.1.1 & 09.1.2   PREMIUM:-
 Entire premium, service tax etc. upto eligible limit of Sum Insured be
 Borne  by the  Company for both  serving and retired employees.
 Difference of premium between optional Sum Insured and eligible Sum
 Insured be paid by the serving & retired employees.

OTHER POINTS:-
a)      Besides hospitalization Bill, fees for Physician/Surgeon/Anaesthesis etc.,
       if separately given be reimbursed without any condition .

b)      No deduction on account of Non-medical items like gloves, Mollysheet,
      micropore cotton etc., and all other items essential for hospitalization be
      included,
c)      80% advance for hospitalisation  for all types of diseases be given  to all
      serving and retired employees.
d)  No outsourcing of Claim settlement by TPA
     As we are settling claims in House of our client like LIC we are competent
     enough to settle our Claim for serving and retired employees. If require Claim
     Hub be formed for Health  insurance in each R.O. of the PSU Insurance companies.

e) Actual Ambulance charges be reimbursed.

Trust,   the suggestions stated above will find due considerations at your
 end before finalizing the Revised GMC Policy so as to cater the needs of
 all the serving and retired employees and we again demand that before
 finalization all the checked-off unions be called for a meeting.

I would request you to  send   the Name of the participants attending the Working Committe Meeting(WCM) on 9th June, 2013,  their date and time of reaching  Mumbai and their food habits by 20th May, 2013 to the undersigned copy to Mr N Panigrahi (09869347189) /  Mr Ravi Swant (09869214448) positively since the WCM will be held at a Hotel named SUVI Palace at VASAI near Borivilie and we have to inform the Hotel Authority the exact number of participants attending the Meeting within 23rd May 2013. If  these  information are not received or any reply or feedback from your end  within the stipulated time,  the participants are to  arrange their  stay of their own.In case number of participants are less than expected figure we have to re-schedule the programme  accordingly.

 Further, I  am confident that  you all  have completed  your target  for  Advertisement collection and in case  of non-completion please exert your every effort to complete the same so that besides fighting  the court cases we shall have to take the account of Functioning of NFGIE, Meeting expenses and Tour Programme etc for the betterment of our beloved organisation.
